Significant changes to legislation
The Child Care Act 2001 was amended to broaden the definition of ‘responsible person’ to include all relevant persons making decisions about the operation of the child care service. Relevant persons will be assessed in relation to fitness and propriety and may be issued letters of censure or fines as part of disciplinary processes for contraventions to the Act, regulations or standards.
Amendments also provided for fitness and propriety checks to be undertaken when people assume relevant roles, previously these were only required as part of the licensing process.

Tasmanian Early Years Foundation Act 2005
New legislation was enacted in 2005 to establish the Tasmanian Early Years Foundation, a non-profit organisation that will support and promote the wellbeing, development and learning of Tasmanian children up to the age of six years. The foundation will:
- provide grants for early childhood projects and initiatives
- promote awareness of the importance of the early years of childhood
- promote research in relation to early childhood wellbeing, development and learning.
