Management of Drug Issues and Drug Education in Tasmanian Schools and Colleges: Tobacco
Students
The law states that a child (under 18 years) must not smoke or use any tobacco product (Public Health Act 1997).
The law also states that a person must not sell, lend, give or supply or offer to sell, lend, give or supply any tobacco product to, or for the use of, any child (Public Health Act 1997).
Students over 18 who smoke are restricted by school policy and relevant Public Health Act provisions.
Employees
The Department of Education has a Smokefree Workplace Policy (updated February 2001) which accords with its occupational health and safety obligation to provide a healthy and safe work environment for all of its employees.
Employees cannot smoke at any time in any Departmental work locations or government vehicles. This policy is effective 24 hours a day, seven days a week.
Smoking must only occur away from the workplace during a recognised break.
Parents & Visitors
Visitors applying to utilise school/college facilities should be informed of the Departments Smoke free Workplace Policy at the time of application.
The Public Health Amendment (Smoke-Free Areas) Act 2001 states that smoking is not permitted within three metres of entrances and exits to buildings, or within ten metres of air conditioning intakes of buildings.
At the discretion of the principal a whole school or college campus may be deemed smoke-free. This extends to a “buffer zone” around crossing guards employed by the State when undertaking their duties at crossings.
Staff have the right to diplomatically ask any person/s to refrain from smoking in smoke-free areas.
